Please read these Terms and Conditions ("Terms") carefully before using the BuildLedger mobile application (the "App") operated by 717 Apps ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Acceptance of Terms
By accessing or using BuildLedger, you confirm that you are at least 13 years of age and have the legal capacity to enter into these Terms. If you are using the App on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
2. Description of Service
BuildLedger is a homebuilding project management application for iOS and iPadOS that helps homeowners track budgets, allowances, selections, change orders, draws, and related documentation during a residential construction project. The App stores data locally on your device and syncs across your devices using Apple's CloudKit (iCloud) service.
3. Beta Program
BuildLedger is currently available as a public beta through Apple TestFlight. By participating in the beta program, you acknowledge that:
- The App is pre-release software and may contain bugs, errors, or incomplete features
- The App may not function as intended and could result in data loss
- We may modify, suspend, or discontinue the beta program at any time without notice
- Beta access does not guarantee access to the final released version
- You are encouraged to provide feedback and report issues to help improve the App
4. User Accounts and Data
4.1 Apple ID
BuildLedger relies on your Apple ID and iCloud account for data storage and synchronization. You are responsible for maintaining the security of your Apple ID and any activity that occurs under your account.
4.2 Your Data
You retain all rights to the data you enter into BuildLedger. All project data—including budgets, selections, change orders, documents, and photos—is stored locally on your device and in your personal iCloud account. We do not have access to, collect, or store your project data on our servers.
4.3 Data Accuracy
You are solely responsible for the accuracy and completeness of data you enter into BuildLedger. The App provides tools for tracking and organizing information but does not verify the accuracy of financial figures, contractor information, or other data you input.
5. Acceptable Use
You agree to use BuildLedger only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the App for any illegal or unauthorized purpose
- Attempt to reverse engineer, decompile, or disassemble the App
- Modify, adapt, or create derivative works based on the App
- Remove, alter, or obscure any copyright, trademark, or proprietary notices
- Use the App in any way that could damage, disable, or impair its functionality
- Attempt to gain unauthorized access to any systems or networks connected to the App
- Use the App to transmit malware, viruses, or other harmful code
6. Intellectual Property
The App, including its design, code, graphics, icons, logos, and documentation, is the intellectual property of 717 Apps and is protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any right, title, or interest in the App beyond the limited license to use it as described herein.
7. Fees and Payments
BuildLedger is currently free during the public beta period. We reserve the right to introduce pricing, subscription plans, or in-app purchases in a future release. Any changes to pricing will be communicated in advance, and beta testers will be notified before any charges apply. Continued use of the App after pricing changes constitutes acceptance of the new terms.
8. Third-Party Services
BuildLedger integrates with Apple's CloudKit (iCloud) for data synchronization. Your use of iCloud is subject to Apple's terms and conditions and privacy policy. We are not responsible for the availability, reliability, or security of third-party services, although we make reasonable efforts to ensure compatibility.
9. Disclaimers
9.1 "As Is" Basis
BuildLedger is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
9.2 No Financial or Legal Advice
BuildLedger is a project tracking and organization tool. It does not provide financial, legal, construction, or professional advice. The information displayed in the App is based solely on data you enter and should not be relied upon as a substitute for professional guidance. Always consult qualified professionals for financial, legal, or construction decisions.
9.3 Accuracy of Calculations
While we strive to ensure the accuracy of calculations within the App, we do not guarantee that all computations, totals, projections, or financial summaries are error-free. You should independently verify important financial figures.
10. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall 717 Apps, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of data, revenue, profits, or business opportunities
- Cost overruns, budget discrepancies, or financial losses related to construction projects
- Damages arising from reliance on information displayed in the App
- Service interruptions, data loss, or software errors
Our total aggregate liability for any claims arising out of or relating to these Terms or your use of the App shall not exceed the amount you paid us for the App in the twelve (12) months preceding the claim, or fifty dollars ($50), whichever is greater.
11. Indemnification
You agree to indemnify, defend, and hold harmless 717 Apps and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the App, violation of these Terms, or infringement of any third-party rights.
12. Termination
We may terminate or suspend your access to BuildLedger at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease. Provisions that by their nature should survive termination shall survive, including ownership, disclaimers, indemnity, and limitations of liability.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by:
- Updating the "Effective date" at the top of these Terms
- Posting updated Terms on our website
- Providing notice through the App for material changes
Your continued use of BuildLedger after changes are posted constitutes acceptance of the updated Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Pennsylvania, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Pennsylvania.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and 717 Apps regarding the use of BuildLedger and supersede all prior agreements, representations, and understandings.
